Welcome to Fairhand Home Appliances (“Fairhand,” “we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website/store and any related features, tools, content, and services (collectively, the “Services”), and the purchase, delivery, installation, and after-sales service of products sold by Fairhand. Our store is hosted and powered by Shopify.

By accessing the Services or placing an order, you agree to be bound by these Terms, along with our Privacy Policy, Terms of Use, Shipping Policy, Delivery & Installation Policy, Service & Warranty Policy, Return & Refund Policy, Payment Policy, Cancellation Policy, Customer Responsibility Policy, and Complaints & Dispute Resolution Policy (together, the “Policies”). If a topic is addressed by a specific Policy, that Policy controls for that subject.

If you do not agree with these Terms, please do not use the Services.


1) Scope, Eligibility & Acceptance

1.1 Scope. These Terms apply to the sale of refurbished appliances and related services within our serviceable areas (currently Delhi NCR) unless we announce otherwise.
1.2 Age & Capacity. You must be 18+ (or have verifiable guardian consent) and have legal capacity to contract.
1.3 Acceptance. Using the Services or placing an order constitutes acceptance of these Terms and the Policies.
1.4 Changes. We may update these Terms prospectively by posting a new “Last updated” date. Continued use signifies acceptance of changes.


2) Key Definitions

  • “Refurbished”: An item inspected, serviced, and tested to be functionally sound; minor cosmetic variations may exist and do not affect performance.

  • “Dispatch”: Handover of the product to our in-house team or an authorized logistics partner.

  • “Serviceable areas”: Locations where Fairhand offers delivery/installation (displayed at checkout; currently Delhi NCR).

  • “DOA (Dead on Arrival)”: The unit fails to power on or function at delivery/installation.

  • “Accessories/consumables”: Pipes, hoses, stands, stabilizers, wall mounts, filters, batteries, etc., which may be billable if required on site.


3) Products, Descriptions & Availability

3.1 Accuracy. We aim to display product titles, specifications, images, and pricing accurately; errors may occur. We may correct errors and update information without prior notice.
3.2 Refurbished Condition. Images are representative; refurbished products may have minor cosmetic differences that do not impact functionality.
3.3 Availability. Stock can vary by location. If an item you ordered becomes unavailable, we may cancel and refund any prepayment (if collected) or propose alternatives.
3.4 Dimensions & Fit. Please verify dimensions and site feasibility (doorways, stairwells, service lift) before ordering. See Customer Responsibility Policy.


4) Pricing, Taxes & Invoices

4.1 Currency. All prices are in Indian Rupees (INR).
4.2 Taxes. Prices include or exclude taxes as indicated at checkout; your tax invoice will reflect applicable taxes.
4.3 Errors. If we discover a pricing error after your order, we may cancel and refund any prepayment or seek your consent to proceed at the corrected price.
4.4 Location Variance. Prices may differ by city/service area due to logistics and installation costs.


5) Orders, Acceptance & Cancellation

5.1 Offer & Acceptance. Placing an order is an offer to buy. We accept once we confirm availability and prepare your order for dispatch.
5.2 Verification. We may verify orders (calls/WhatsApp) for fraud prevention or delivery feasibility.
5.3 Our Right to Cancel. We may cancel any order (e.g., suspected fraud, pricing error, unserviceable address). Prepayments, if any, are refunded per Payment/Cancellation policies.
5.4 Your Right to Cancel. You may cancel before dispatch per the Cancellation Policy. After dispatch/out for delivery, cancellation is typically not permitted.


6) Payments & Security

6.1 Standard Flow (Risk-free). We typically collect payment after successful delivery, installation, and demo (COD/UPI). See Payment Policy.
6.2 Advances. For certain cases (special orders/scarce stock), a small advance may be requested and clearly communicated before confirmation.
6.3 Methods. COD, UPI (Google Pay, PhonePe, Paytm, BHIM), bank transfer (by arrangement), and gateway methods as enabled from time to time.
6.4 Security. Payments are processed via trusted gateways; we do not store card numbers or UPI PINs.
6.5 Chargebacks. If disputing a charge, also notify support@fairhand.in to expedite resolution.


7) Shipping, Delivery & Installation

7.1 Service Areas & Timelines. We deliver within serviceable areas; typical timelines are 1–3 working days post-processing, subject to stock and scheduling.
7.2 Free Doorstep Delivery & Installation. Included for eligible products; extra fittings (pipes, stands, stabilizers, mounts, filters) are billed separately when needed.
7.3 Scheduling & Access. We coordinate slots via call/SMS/WhatsApp. Arrange entry permits, service lift, and parking as needed.
7.4 Missed Attempts. If nobody is available or access is denied, the attempt may be marked failed; we will reschedule. Repeated failures may incur a re-delivery fee.
7.5 Installation Scope. Unboxing, placement, basic connections, functional test, and demo. We do not perform building plumbing/electrical alterations.

8) Title, Risk & Acceptance

8.1 Transfer. Title and risk pass to you upon delivery and installation sign-off at your address.
8.2 Inspection at Delivery. Our technician will test the unit (power on, quick cycle/cooling/display/flow as applicable).
8.3 Acceptance. Once installed and demoed, the product is considered accepted, subject to the DOA window below.


9) DOA, Returns & Refunds

9.1 DOA Window. If the unit is non-functional at installation or exhibits a verifiable functional defect within 7 days, it qualifies for free replacement upon technician verification (see Return & Refund Policy).
9.2 Cosmetic Variations. Minor cosmetic differences common to refurbished goods are not DOA/return grounds if functionality is unaffected.
9.3 Refunds (When Applicable). Since payment is usually after installation, refunds are rare but may apply to prepaid orders cancelled before dispatch, DOA with no replacement available in reasonable time, or duplicate/overpayment (see Return & Refund Policy for timelines/methods).
9.4 Condition for Exchange. Keep accessories/fittings available; tampering or unauthorized repairs may void eligibility.


10) Warranty & Service (Seller Warranty)

10.1 Coverage. Standard 180-day seller warranty on eligible products unless stated otherwise; covers functional defects under normal use.
10.2 Exclusions. Physical damage after delivery, misuse/overloading, unauthorized repairs, external causes (voltage surges, plumbing leaks, poor drainage), and consumables.
10.3 Remedy Hierarchy. Repair first; if not feasible, replacement of equal or better specification.
10.4 Process. Report issues to support; a technician inspection (in-person/video triage) may be required.
10.5 Post-Warranty. Paid service available (visit + parts at cost).

11) Accessories, Add-Ons & On-Site Decisions

11.1 Necessity & Pricing. Our technician may recommend accessories only if required for safe/optimal operation; prices are disclosed before installation.
11.2 Billing. Accessories may be added to your invoice and paid via COD/UPI on the spot.
11.3 Receipts. Keep receipts for future service references.


12) Customer Responsibilities

12.1 Site Readiness. Provide adequate space, clear pathways, correct power and, where relevant, water inlet/outlet and drainage.
12.2 Access & Permissions. Arrange building entry passes, service lift access, and permitted time windows.
12.3 Presence. Ensure a responsible adult is present for delivery, installation, and demo; finalize payment after install.
12.4 Safe Use. Operate per demo/manual; avoid misuse/overloading; use stabilizers where advised.
12.5 Documentation. Retain invoice/warranty card; share photos/videos for service verification if requested.

13) Prohibited Conduct (Purchases & Services)

You may not:

  • Provide false information or engage in fraudulent transactions;

  • Obstruct inspections or tamper with serial/QA labels;

  • Abuse staff or create unsafe conditions for visits;

  • Repeatedly misuse cancellations/returns to block inventory;

  • Resell products commercially without authorization.

We may refuse service, cancel orders, or restrict accounts for violations.


14) Intellectual Property

14.1 Ownership. All Site/store content (text, logos, images, product photos, videos, icons, UI) is owned by or licensed to Fairhand and protected by IP laws.
14.2 Use Limits. Do not copy, modify, or distribute content without our written consent.
14.3 Trademarks. “Fairhand” and associated marks are our trademarks; no license is granted by implication.


15) Communications & Marketing

15.1 Operational Messages. We may send order updates, installation schedules, and service notices via SMS/WhatsApp/email.
15.2 Promotions. With consent where required, we may send promotional messages; you can opt out anytime (see Privacy Policy).


16) Privacy & Data Protection

16.1 Hosting by Shopify. Our store runs on Shopify, which processes certain data to provide and improve the platform.
16.2 Your Rights. See our Privacy Policy for details on what we collect, how we use/share it, your choices, and how to contact Shopify for platform-specific rights.


17) Third-Party Services & Links

The Services may link to or integrate with third-party tools (payment gateways, maps, analytics). We are not responsible for third-party content, policies, or practices. Review their terms/privacy before use.


18) Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, government actions, network outages, logistics disruptions, or similar events. We will reschedule delivery/service as soon as practicable.


19) Disclaimer of Warranties (Services)

Except as expressly set out in these Terms and the Service & Warranty Policy, the Services (website/store content, availability, information) are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, we disclaim all such warranties regarding the Services.


20) Limitation of Liability

To the maximum extent permitted by law:
20.1 Indirect Losses. Fairhand is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption.
20.2 Cap. For purchase-related claims, our total liability shall not exceed the price you paid for the product at issue. For Site-only claims (not tied to a purchase), the cap is INR 5,000.
20.3 External Conditions. We are not responsible for damages caused by power surges, faulty in-premise plumbing, or site conditions outside our control.

Nothing in these Terms limits liability where such limitation is prohibited by law.


21) Indemnification

You agree to defend, indemnify, and hold harmless Fairhand and our affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your breach of these Terms or the Policies,

  • your misuse of products or Services, or

  • your violation of third-party rights.


22) Disputes, Complaints & Escalation

22.1 Internal Resolution First. Contact support@fairhand.in or +91 8929 688 668. We follow the Complaints & Dispute Resolution Policy (acknowledge within 48 working hours; target resolution windows communicated).
22.2 Jurisdiction. If unresolved, disputes are subject to the exclusive jurisdiction of the courts in New Delhi, India.
22.3 Good-Faith Resolution. Both parties agree to attempt an amicable settlement before legal action.


23) Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.


24) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.


25) Severability & Waiver

If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of that right.


26) Notices

We may send legal/operational notices via the email/phone provided by you or by posting on the Site. You must keep your contact details current.


27) Entire Agreement; Order of Precedence

These Terms plus the Policies constitute the entire agreement between you and Fairhand regarding purchases and Services. If there’s a conflict:

  • The specific Policy controls for its subject (e.g., refunds → Return & Refund Policy).

  • Otherwise, these Terms control.


28) Survival

Sections that by nature should survive (e.g., IP, warranty exclusions, disclaimers, limitations of liability, indemnity, governing law, jurisdiction, assignment, entire agreement) survive termination or completion of a sale.
