Welcome to Fairhand Home Appliances (“Fairhand,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, mobile experiences, content, features, and tools (collectively, the “Site”). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our other applicable policies referenced below.

Order of precedence: These Terms govern Site use. If you make a purchase, our Terms & Conditions (sales terms) will apply to the transaction. If there is a conflict between these Terms and any specific policy referenced herein, the more specific policy (e.g., Warranty, Shipping) controls for that subject.

1) Acceptance of Terms

  • By using the Site, you accept these Terms and our Privacy Policy, Terms & Conditions, Delivery & Installation Policy, Return & Replacement Policy, Payment Policy, Cancellation Policy, Customer Responsibility Policy, Complaints & Dispute Resolution Policy, and Shipping Policy.

  • If you do not agree, you must not use the Site.

  • We may update these Terms at any time. The updated Terms will be effective when posted with a revised “Last updated” date. Continued use of the Site means you accept the changes.

2) Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or have verifiable parental/guardian consent.

  • You must have the legal capacity to enter into a binding agreement under applicable law.

3) Accounts, Security & Authentication

  • You may browse portions of the Site without creating an account. Some features may require registration.

  • You agree to provide accurate, current, and complete information and to keep it updated.

  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

  • Notify us immediately of unauthorized access or suspected breach at support@fairhand.in.

  • We reserve the right to refuse, suspend, or terminate accounts for violations of these Terms, suspected fraud, or risk to Fairhand or our users.

4) License to Use the Site

  • We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site strictly in accordance with these Terms.

  • You may not:

    • Copy, modify, reverse engineer, or create derivative works of the Site or its content.

    • Scrape, harvest, or use automated means (bots, crawlers) to access the Site without our written consent.

    • Interfere with the Site’s operation, security, or integrity.

    • Use the Site for fraudulent, harmful, or unlawful purposes.

5) Intellectual Property

  • All content on the Site—including text, graphics, logos, product photographs, videos, icons, software, and design—is owned by or licensed to Fairhand and protected by intellectual property laws.

  • “Fairhand,” our monogram/logo, product images, and all related marks are trademarks or trade dress of Fairhand. No license to use our marks is granted by implication or otherwise.

  • You may not reproduce, distribute, publicly display, or exploit any content without our prior written permission.

6) User Submissions, Reviews & Feedback

  • If you submit reviews, comments, photos/videos, suggestions, or other content (“User Content”), you represent and warrant that:

    • You own or control the rights to the User Content.

    • Your User Content is accurate, lawful, and does not infringe any third-party rights.

    • Your User Content complies with these Terms and any posted guidelines.

  • You grant Fairhand a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, translate, publish, and display your User Content in connection with the Site, marketing, and our services.

  • We may monitor, edit, or remove User Content at our discretion for any reason (e.g., illegal, offensive, misleading, or non-compliant content), but we are not obligated to do so.

7) Acceptable Use & Prohibited Conduct

You agree not to:

  • Violate any applicable law or regulation.

  • Post or transmit content that is unlawful, defamatory, harassing, hateful, obscene, or that promotes violence or illegal activity.

  • Impersonate any person or entity, or misrepresent your affiliation.

  • Upload malware, spyware, or code that could harm the Site or users.

  • Engage in activities that could disrupt, overload, or interfere with the Site’s infrastructure or security.

  • Bypass or circumvent access controls, payment gates, or digital rights management.

  • Use the Site for competitive intelligence, scraping catalog data, or to build a competing service.

8) Product Information & Availability on the Site

  • We strive for accuracy in product titles, specifications, images, pricing, and availability, but mistakes may occur. Colors and finishes may vary due to screen settings and lighting; refurbished items may have minor cosmetic variations.

  • Information on the Site is subject to change without notice. Availability may differ by city/area.

  • Any reliance on Site material is at your own risk. We reserve the right to correct errors and update information at any time.

9) Purchases & Transactions

  • Purchases are governed by our Terms & Conditions and all relevant policies referenced there.

  • Key points (summary only; see full policies for details):

    • COD/UPI after installation for most orders.

    • Free delivery & installation within serviceable areas; accessories may be charged.

    • 180-day seller warranty on eligible items.

    • 7-day DOA replacement (post-verification).

  • If anything in these Terms conflicts with the purchase terms, the Terms & Conditions control for the transaction.

10) Privacy, Cookies & Marketing Preferences

  • Your privacy matters. Our Privacy Policy explains what we collect, why, and how we use/share your information, including Shopify hosting and services.

  • The Site uses cookies and similar technologies to enable features, analytics, and personalization. Manage preferences as described in the Privacy Policy or your browser.

  • You may receive transactional communications (order updates, service alerts). You may opt out of promotional communications at any time as described in the Privacy Policy.

11) Third-Party Services, Links & Social Features

14) Disclaimer of Warranties (Site)

  • The Site and its content are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the Site will be error-free or uninterrupted.

  • To the extent permitted by law, we disclaim all warranties related to Site access, content accuracy, and availability.

15) Limitation of Liability

  • To the maximum extent permitted by law, Fairhand shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from or related to your use of or inability to use the Site.

  • Where liability cannot be excluded, our total liability shall not exceed the amount you paid to use the Site (if any) or INR 5,000, whichever is lower—excluding claims governed by the Terms & Conditions for product purchases (where the purchase-specific cap applies).

16) Indemnification

You agree to defend, indemnify, and hold harmless Fairhand and our affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Site,

  • Your User Content,

  • Your violation of these Terms or applicable law,

  • Your infringement of any third-party rights.

17) Reporting IP Infringement

  • We respect intellectual property rights. If you believe content on the Site infringes your IP, email support@fairhand.in with:

    • Identification of the work/mark you claim is infringed,

    • The exact URL(s) or description of the allegedly infringing material,

    • Your contact details,

    • A statement of good-faith belief and authority to act.

  • We may remove or disable access to the material pending review.

18) Suspension & Termination

  • We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or pose a risk to us or other users.

  • Upon termination, the rights granted to you under these Terms will cease immediately. Sections that by their nature should survive (e.g., IP, disclaimers, limitations of liability, indemnity, governing law) will continue to apply.

19) Governing Law & Jurisdiction

  • These Terms are governed by the laws of India.

  • Any disputes relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

  • Before litigation, both parties agree to attempt an amicable resolution in good faith.

20) Force Majeure

  • We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, acts of government, strikes, power outages, network failures, or logistics disruptions.

21) Assignment

  • You may not assign or transfer any rights or obligations under these Terms without our prior written consent.

  • We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets.

22) Severability & Waiver

  • If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

  • Our failure to enforce any right does not constitute a waiver of that right.

23) Entire Agreement

  • These Terms, together with the policies referenced herein (and, for purchases, the Terms & Conditions), constitute the entire agreement between you and Fairhand concerning Site use.
